Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of InfraFence at infrafence.com, its dashboard, API and agent (the "Service"), operated by ComCart S.r.l., Via Giacomo Matteotti 43, 47043 Gatteo (FC), Italy, VAT IT04412340400 ("we", "us"). By creating an account or using the Service you accept these Terms. If you do not accept them, do not use the Service.

2. The Service

InfraFence protects Linux servers. An agent you install on your servers detects attacks and reports security events to the dashboard, where you see them, configure protection and receive alerts. Depending on what you enable, the Service includes:

• brute force detection and automatic banning on the server's firewall
• web application firewall rules, bot management and country blocking
• malware scanning, file integrity and outbound/DNS threat detection
• hardening checks, vulnerability (CVE) reports and a security score
• alerts by email, Slack, Discord, Telegram or webhook, and incident analysis

The agent is source-available software under the Business Source License 1.1 published in its repository, which governs its use. It keeps enforcing the last protection rules it received when the dashboard can't be reached.

Aggregated network statistics: we compute anonymous statistics of the attacks seen across all servers (countries, attack types, ports, trends) and show them to every customer. They never include customer names, hostnames or server addresses, and a figure is shown only when at least 3 organizations contribute to it.

3. Accounts

You must be at least 18 years old and give accurate information. You are responsible for your credentials, for the members you invite to your organization and for everything done with your account. We recommend turning on two-factor authentication.

Tell us at info@infrafence.com as soon as you suspect unauthorized use of your account.

4. Plans and billing

The Starter plan is free for one server, with no time limit and no credit card. The Pro plan is billed per server, monthly or yearly, at the prices on our pricing page. Payments are processed by Stripe; by subscribing you also accept Stripe's terms for the payment.

Fees are charged in advance and the subscription renews automatically at the end of each period until you cancel it. The number of servers billed follows the servers registered in your organization, with a prorated charge or credit when it changes. A new account gets 14 days of the AutoMode plan free of charge, without a payment card, starting when its email address is confirmed; this free period is available once per organization and replaces any trial at checkout. At its end the organization moves to the free Starter plan unless a paid plan has been chosen: the server connected first stays protected and the other servers are paused until a paid plan is chosen. Choosing a paid plan during the free period ends it, and that plan is charged from that day.

5. Cancellation

You can cancel at any time from Settings → Plan & billing. Pro stays active until the end of the period already paid, then your organization moves to the Starter plan. If a payment fails, the paid plan stops 72 hours after the failed payment unless it goes through: the organization then moves to Starter, and servers beyond the Starter limit are no longer protected.

6. Refunds

If you are not satisfied, we refund your first payment in full when you ask within 30 days of it, at info@infrafence.com. Apart from that, periods already started are not refunded, without prejudice to the rights consumers have under the law.

7. Acceptable use

You agree not to:

• use the Service for anything illegal
• install the agent on servers you don't own or aren't authorized to manage
• use the Service to attack, scan or probe third-party systems
• attempt to access other customers' data or interfere with the platform's infrastructure
• work around the limits of your plan, or resell access to the Service without our written consent
• submit false or misleading data to the InfraFence network

We may suspend or close accounts that break these rules; for serious breaches without notice.

8. Your responsibilities on your servers

The Service acts on your servers: it adds firewall rules and bans addresses, and, only if you allow it, changes web server configuration. Firewall rules decide who can reach your server, so a mistake can block legitimate traffic or your own access. By using the Service you accept that:

• you add your own addresses and those of your administrators to the whitelist before relying on automatic protection
• bans, country blocks and rules you create by hand apply immediately and are your responsibility
• you keep a way to reach your servers that doesn't depend on their firewall (your provider's console, KVM/IPMI or physical access)
• you keep your own backups and recovery procedures
• automatic detection can produce false positives; the whitelist and monitor mode are the tools to limit them

We are not liable for loss of access to your servers caused by rules or bans applied by the agent, whether you configured them or the detection applied them automatically.

9. Optional features

AI incident analysis is generated by a third-party AI provider, only when you ask for it, and may be inaccurate: it supports your decisions, it doesn't replace them. The InfraFence network is off unless you turn it on; when on, the addresses that attacked your servers are pooled with other customers' as described in the Privacy Policy.

10. Intellectual property

The dashboard, the website, the InfraFence name and logo belong to us; these Terms give you no ownership of them, only the right to use the Service for your own infrastructure under your plan. The agent is source-available under the Business Source License 1.1 published in its repository, which governs its use.

IP geolocation in the Service uses the IP to Country Lite database by DB-IP (https://db-ip.com), licensed under the Creative Commons Attribution 4.0 International License (https://creativecommons.org/licenses/by/4.0/).

11. Data and privacy

How we handle personal data is described in our Privacy Policy, which is part of these Terms. The agent sends security events only, never your full logs, files or application data.

12. Availability

We do our best to keep the Service available but don't guarantee it is uninterrupted or error-free, and no service level is offered on the Starter plan. Maintenance, updates and events outside our control may make the dashboard temporarily unavailable; the agent keeps protecting your servers in the meantime.

13. No warranty

The Service is provided "as is" and "as available". No security product stops every attack: we don't warrant that every threat will be detected or blocked, nor that the Service fits your specific needs.

14. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential damages, including lost profits or data, attacks the Service didn't detect, interruptions of the Service, false positives, or actions taken automatically by the Service such as bans and country blocks.

Our total liability for any claim relating to the Service is limited to the greater of what you paid us in the 12 months before the event and EUR 100. Nothing in these Terms limits liability for wilful misconduct or gross negligence, or any liability that cannot be limited by law.

15. Indemnification

You will hold us harmless from claims by third parties arising from your use of the Service in breach of these Terms, including claims from people whose access to your servers was affected by rules you configured.

16. Changes

We may change these Terms. We will email account owners about material changes at least 30 days before they take effect. If you don't agree with the new Terms, you can cancel before then.

17. Governing law

These Terms are governed by Italian law. The courts of Forlì have jurisdiction, except that consumers living in the European Union keep the protection of the mandatory laws and courts of their country of residence.
